What is the Wage and Hour Division?

The Fair Labor Standards Act, known as FLSA, oversees the dictation of a lot of financial aspects of running a business. But Georgian business owners like you may be wondering, what are the other parts of the FLSA?

One is the Wage and Hour Division, or WHD. According to the United States Department of Labor, this is the aspect of the FLSA that determines how an employee’s hours should be divided, and the wages they should be paid in accordance to those divisions. For example, the WHD shows who should be eligible for overtime and when the overtime pay should be granted. Anyone who works over 40 hours a week should receive overtime pay that is not less than 1.5 times their rate of pay. This includes holidays, weekends and rest days. However, the FLSA doesn’t require these days to automatically get overtime pay as some businesses do.

The FLSA also covers minimum wage. For example, the current minimum wage federally is $7.25 an hour. If a state minimum wage is lower than the federal one, the employee is actually entitled to the wage that’s higher, which is something for employers and employees alike to keep in mind.

Excerpts of the law also dictate how work hours are recorded, how pay is recorded, and what times an employee could be considered being at work. Likewise, the FLSA covers child labor, determining that minors who work detrimental jobs must still have fair access to education, and that their jobs cannot get in the way of said education.

It is important to understand these aspects of work clearly, so that you aren’t missing out on payment, time off, benefits, and so on.
