Restaurant chain agrees to settle wage and hour complaint

Georgia restaurant owners know how difficult it can be to own a business in the food services industry. Numerous issues require daily attention from owners and managers in order to avoid losing customers, which are undoubtedly the lifeblood of any successful restaurant. One issue that can be difficult at times is the potential for a wage and hour complaint due to laws that apply to the compensation of restaurant workers.

Hooters files business litigation against escort service

Many jokes have been made at the expense of Georgia-based Hooters of America. However, the popular restaurant chain is not joking about the business litigation it recently filed against an escort service. The suit, which was filed in federal court, alleges the escort service not only used the company's name without permission, but its logo as well.

Roadblock to covenants not to compete could be choice of law

Many Georgia employers require both in-state and out-of-state employees to sign non-compete agreements. When it comes to out-of-state employees and covenants not to compete, many include a choice of law provision. However, just because a choice of law is included in a contract does not mean it will be upheld.

Georgia company buys Land Rover franchise

Georgia based Asbury Automotive Group has decided to branch out. The company has purchased a Land Rover franchise that it plans to merge into its Jaguar dealership. The acquisition is in line with the desires of Tata Motors, which combined the Jaguar and Land Rover brands after purchasing them in 2008 from Ford.

Settlement of class action business litigation challenged by BP

Nearly everyone in Georgia heard about the BP oil spill in the Gulf of Mexico in 2010. In Dec. 2012, a United States District Court judge certified a class in business litigation filed on behalf of those harmed by the oil spill who may be eligible to participate in a settlement brokered between BP and plaintiffs which was also approved by the judge. When BP appealed the certification and the district court's approval of the settlement to the U.S. 5th Circuit Court of Appeals, the district court's ruling was upheld.
