Aetna sues watchdog group

Aetna has been in an ongoing battle with the non-profit Consumer Watchdog. The latter sued the insurance carrier for insisting that HIV medication be handled by mail rather than customers going to a pharmacy. The bigger issue, however, was that the insurance provider’s correspondence and delivery of the medication used paned envelops that revealed thousands of customer’s HIV status next to their name and address.

Consumer Watchdog won the last round in 2014 and received a $20 million settlement, but Aetna now has countersued, claiming that the organization and lawsuit created the issue.

Aetna’s 2018 lawsuit on shaky ground

According to an article in May of 2018, the new lawsuit contends that Consumer Watchdog’s lawyers demanded Aetna supply confidential information about its clients to the lawyers, and then failed to assure that none of the information would be exposed in the settlement notification mailing. Aetna wants the organization and its law firm to pay back the money as well as additional damages for the settlements and fines it was forced to pay.

Consumer Watchdog responds

According to Harvey Rosenfield of Consumer Watchdog, "Aetna's attempt to blame us is a frivolous waste of judicial resources and Aetna knows it. We had no control over the mailing process and had no idea that Aetna decided to use an envelope with a giant window that exposed the recipient's HIV status."

Business disputes that never end

This back and forth between the two sides is not the ideal resolution of a lawsuit. Moreover, Aetna and its law representation have also filed lawsuits against each other in response to the 2014 ruling. Law firms businesses in a dispute normally strive to find a resolution and adhere to the ruling, or appeal the ruling in Appellate Court. This back and forth can end up causing the clients a great deal of frustration while also adding additional expense that may not be necessary.
