Claims Of Breach Of Fiduciary Duty By Trustees And Estate Representatives
Trustees and estate representatives (executors) hold the highest duty that exists under Georgia law. These fiduciaries are required to act solely in the best interests of the estate and the beneficiaries of the estate or trust, and to refrain from acting with self-interested motives or engaging in self-dealing. They are also obligated to manage the estate or trust with an appropriate level of care and skill. If they fail to do so, beneficiaries may have a legitimate claim for damages.
Our attorneys can represent either the beneficiaries or the trustee or executor in the litigation of claims involving
breach of fiduciary duty or a variety of other issues. Potential clients who suspect wrongdoing on the part of a trustee or executor are encouraged to bring the matter to the attention of one of our attorneys as soon as possible. Common claims include:
- Mismanagement of trust investments
- Directing fund investments to benefit someone other than the beneficiary
- Failure to keep fund accounts separate from other accounts
- Refusal to pay out trust fund monies appropriately
- Failure to minimize taxes or fees
- Unauthorized borrowing from the estate or trust
- Other conflicts of interest
- Fraud and other criminal acts
